The term "retailer" or "shop" refers to a customer who uses the Shop Account products available on the website. The term "Seller" refers to a customer who uses any of the regular advertising products available on the website. The term "advertisement" or "ad" refers to a specified space on the website that has been paid for by a seller to sell an item.

The use of this website is subject to the following general terms of use:

• The content of the pages of this website is for your general information and use only. It is subject to change without notice.
• Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Sellers

The use of the website for selling items are subject to the following terms of use:

• Advertisements must not include links or references to sites that do not offer any additional information about the advertised item.
• Advertisements must be "classified in nature". This requires advertisements be strictly for a single item or set of directly related items. We reserve the right to determine whether or not an advertisement is considered a single or set of related items.
• It is the responsibility of the seller to remove advertisements that have been sold or are no longer for sale.
• Sellers who own an ad that have been inactive for longer than 3 months will be notified by email and informed that they have 7 days to either update the ad or to remove it from the website. If no action is taken by the seller in or after 7 days, the advertisement will be removed from website.
• No exclusive rights to any portion of the website are granted to a seller upon payment of fees.
• A seller must not amend an advertisement to represent a different item other than the item originally for sale in that advertisement.
• All transactions that may take place between a buyer and seller will in no way involve Sellyourbike.com.au. Buying and/or selling products though this website is the total responsibility of the users.
• All items for sale must be cycling related. We reserve the right to determine whether or not an item is considered to be cycling related. Ads that are not considered to be cycling related can be removed without notice, and without refund at our discretion.
• Advertisements must only include textual information about the item for sale and graphics. Under no circumstance is a seller permitted to upload scripts, code, html, css, viruses, Trojan Horses or any other digital item that could alter the form or function of the website.
• The seller assigns all copyright of information and graphics uploaded to the site to Sellyourbike.com.au. It is completely the seller's responsibility to obtain permission from the original owners of all information and graphics which is not the copyright of the seller.
• The seller must be legally able to sell the advertised item and, if requested, provide evidence to prove the latter is true.
• Sellers must not submit illegal content or information to the site. Such content may be reported to the relevant authorities along with the user's information.
• If an advertisement is received by a seller at a discounted or complimentary fee, the seller is not entitled to the same service as that granted to a seller who purchases an ad at full rates. The seller is however bound by the same terms and conditions.
• All fees listed on the website for products or services are subject to change without notice, with the exception of Shop Account fees, in which case, the account owner will be given 18 days notice of fee, protocol, frequency and charge date information. All fees are inclusive of GST.

Buyers

The use of the website for buying items are subject to the following terms of use:

• Sellyourbike.com.au reserves the right to monitor and record email enquiries and the IP address of the buyer.
• Sellyourbike.com.au makes no warranties of the authenticity of sellers, users or products for sale. All communications between the buyer and users or sellers is conducted entirely at the buyers own risk.

Retailer/Shop Accounts

Shop Account products are based on a term subscription and have a minimum duration. The term of a service or product is clearly stated when the product or service is purchased. Exiting a term agreement before the minimum duration will incur a one month equivalent fee as specified by the products monthly price description. The remainder of the original sum, minus the fees incurred in the period from the initial date to the date of termination, will be refunded to the customer. Use of the product or service will be available to the customer until the end of the current billing period.

Fees are charged on a monthly, biannually or annually basis depending on the service or product. A 'Month' subscription is charged monthly and carries a minimum one month term. A '6 Month' subscription is charged biannually and carries a minimum six month term. A '12 Month' subscription is charged annually and carries a minimum twelve month term. Payments are charged to an account relative to the initial subscription date. A 'Month' subscription's charge date for the next payment following an initial payment is due one month after the initial date. A '6 Month' subscription's charge date for the next payment following an initial payment is due six months after the initial date. A '12 Month' subscription's charge date for the next payment following an initial payment is due twelve months after the initial date. If a payment falls on a month day that does not exist for that particular month, the payment will be charged the following day.

Tax Invoices for product payments will only be available to retailers who can provide a valid ABN number and contact information, including but not limited to the following; contact phone number, commercial address and email address.

We will continue to charge customers once the accounts minimum term has been reached and will do so until we have been duly notified, in writing, with a request to cancel the service. Cancelation Request letters must be printed or written on the retailer's letterhead and signed by a manager or higher with proper authority to cancel the account.

Cancellation of a Shop Account subscription must be submitted and accepted by Sellyourbike.com.au before next month, 6 month or 12 month payment date. Cancellation requests received after the renewal date will incur one month penalty and the remaining funds will be refunded. Cancelation Request letters must be printed or written on the retailer's letterhead and signed by a manager or higher with proper authority to cancel the account.

Payment details, such as credit card numbers, are required to be stored so that recurring payments can be processed. Sellyourbike.com.au does not, and will never, store these details on our own system. All payment details are transferred securely to a Payment Gateway and stored on a PCI DSS (Payment Card Industry Data Security Standards) compliant platform. Unless otherwise agreed upon, your payment details will be kept confidential except when the data is required to perform charging on the attached account. Your information may also be required in the unlikely event of wrongful or incorrect withdrawal claim.

By agreeing to the Retailer/Shop Accounts terms and conditions you are authorising Sellyourbike.com.au to charge due amounts from your specified credit card in payment for funds that have been incurred by products or services as requested by you.
